JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]On 20 June 2023 the claimant informed the Tribunal that they had privately settled with the Respondent and asked for the hearing to be cancelled.[2]The Tribunal wrote to the Claimant on 10 July 2023 asking if the settlement had been implemented and whether the Claimant was now in a position to withdraw her claim. No reply to this correspondence was received from the claimant. A strike out warning letter was then issued on 20 July 2023 giving the claimant until 28 July 2023 to respond[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
