Ms C Fortune v Stobo Castle: 4102165/2020

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4102165/2020
Ms Carole FortuneClaimantStobo CastleRespondent
Employment Judge Neil BuzzardDate 27 December 2020

JUDGMENT

[1]The claimant claimed discrimination relying on her anxiety as qualifying as a disability as defined by the Equality Act 2010. No other potential disability was relied on.[2]The finding of the Tribunal is that the claimant has not presented evidence that could establish her anxiety had, at the time of the alleged discrimination, had substantial long term effects of the claimant’s ability to carry out day to day activities. For this reason the claimant has not shown her anxiety is a disability. E.T. Z4 (WR)[3]Because all the claimant’s claims rely on her anxiety being shown to meet the definition of a disability, the claimant’s claims must fail and are dismissed.
