JUDGMENT
[1]The Claimant’s unauthorised deduction from wages claim under s.13(1) of the Employment Rights Act 1996 (Respondent’s failure to pay Claimant’s wages covering period 1-26 October 2022) is well-founded.[2]The Respondent shall pay the Claimant the sum of £1,962.58 (26/31 x £2,340 net monthly wage).[3]The Claimant’s claim that the Respondent breached his statutory right under s.8(1) of the Employment Rights Act 1996 to be given a written itemised pay statement regarding his wages for the period 1-26 October 2022 is well founded.[4]The Tribunal makes a declaration to that effect under s.12(3)(a) of the Employment Rights Act 1996.[5]The Tribunal has no jurisdiction to consider the following claims:a. Claimant’s application for a P45 from the Respondent following termination of his employment on 26 October 2022;b. Claimant’s application for clarification of taxes withheld and/or deductions made in respect of his wages since 1 June 2022;c. Claimant’s application for his employee ID number (left blank on earlier payslips). NOTE 1 . Judgments are published online after they have been sent to the parties. 2. Reasons for the Judgment having been given orally at the final hearing, written reasons will not be provided unless a request is made by either party at that hearing or within 14 days of the sending of the written record of the decision. If no such request is received, the Tribunal will provide written reasons for the decision only if requested to do so by the Employment Appeal T ribunal or a court.
