JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1 )(d)REASONS
[1]By letter dated 18 March 2020, the Tribunal requested the claimant to return the date listing form issued on 1 1 February 2020. The form was to have been returned by the claimant within 28 days of 1 1 February 2020. The claimant has not returned the form. By letter dated 28 May 2020, the Tribunal requested the claimant to provide written comments on the respondent’s representative’s request for further and better particulars by 11 June 2020. The claimant did not respond. By letter dated 24 June 2020, the Tribunal notified the claimant that it was considering striking out her claim on the ground that it had not been actively pursued. The claimant was told that if she disagreed she should set out her reasons in writing by 8 July 2020. The claimant failed to respond.[2]On 24 June 2020 the Tribunal gave the claimant an opportunity to give written reasons by 8 July 2020 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The T ribunal therefore strikes out the claim.
