JUDGMENT
The complaint of Unfair Dismissal having been withdrawn by the claimant is dismissed under Rule 52 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. JUDGMENT Rule 21 of the Employment Tribunal Rules of Procedure 2013 No response has been presented to this claim and an Employment Judge has decided to issue the following judgment on the available material under Rule 21:[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the clamant in the sum of £575 (Five Hundred and Seventy Five Pounds) being 5 weeks pay in lieu of notice. The claimant was paid £115 per week and had 5 complete years service at date of dismissal.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £862.50 (Eight Hundred and Sixty Two Pounds, Fifty Pence) being calculated on the basis of the following which applied at date of termination of employment: age (59), length of service (5 years) and weekly wage (£115).[3]The claims directed against Manjit Kaur and Manjit Kaur t/a Costcutter Greenock is dismissed.
