Claimant Respondents The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds• that it has no reasonable prospect of success in terms of rule 37(1)(a)• that the claim has not been actively pursued in terms of rule 37(1 )(d)REASONS
[1]On 12 March 2021 the Tribunal wrote to the claimant seeking their comments on the liquidator’s correspondence indicating that consent had not been given for the claim to proceed. The claimant was given 14 days to inform the Tribunal of the steps they intended to take in order to obtain the consent of the court. No response was received from the claimant and on 14 April 2021 , the T ribunal wrote to the claimant again to request their comments on the liquidator’s correspondence and clarification of the steps they intended to take to obtain consent. No reply was received from the claimant.[2]On 1 1 May 2021 the Tribunal gave the claimant an opportunity to give written reasons by 25 May 2021 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
