JUDGMENT
[1]the claim is, having been withdrawn under rule 51 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 (the Rules), is dismissed under Rule 52 of the Rules; and[2]the hearing on 11, 15 and 16 May 2023 is discharged.REASONS
[1]The claimant presented a claim of unfair dismissal. A final hearing was set down for 4 days, commencing on 9 May 2023. The claimant did not attend the hearing, but Mr Lyons for the respondents was in attendance.[2]On the morning of the first day of the hearing, the Tribunal received written notice from the claimant of withdrawal of his claim.[3]The Tribunal according accepted that withdrawal under Rule 51 of the Rules and dismissed the claim under Rule 52.
