JUDGMENT
No response has been presented to this claim and an Employment Judge has decided to issue the following judgment on the available material under rule 21:[1]The claimant’s claim of unfair dismissal fails for lack of qualifying service and is dismissed.[2]The claimant’s claim of unlawful deduction of wages succeeds and the respondent is ordered to pay to the claimant the sum of THREE THOUSAND EIGHT HUNDRED AND EIGHTY FOUR POUNDS AND FORTY SIX PENCE (£3884.46).[3]The claimant’s claim of breach of contract (in respect of notice pay) succeeds and the respondent is ordered to pay to the claimant the sum of EIGHT HUNDRED AND FORTY SIX POUNDS AND FIFTEEN PENCE (£846.15).[4]The claimant’s claim for holiday pay succeeds and the respondent is ordered to pay to the claimant the sum of ONE THOUSAND FOUR HUNDRED AND THIRTY EIGHT POUNDS AND FORTY SIX PENCE (£1438.46).[5]The said sums specified in paragraphs (b), (c) and (d) above are to be paid under deduction of income tax and National Insurance contributions at the applicable rates.[6]The respondent is ordered to pay to the claimant the sum of THREE THOUSAND THREE HUNDRED AND EIGHTY FOUR POUNDS AND SIXTY PENCE (£3384.60) in terms of section 38 of the Employment Act 2002.
