JUDGMENT

[1]The claimant was dismissed by reason of his conduct. His claims for unfair dismissal pursuant to both s. 98(4) and 103A Employment Rights Act 1996 as amended are not well founded and are dismissed.[2]The claimant acted unreasonably by pursuing the claim after 27 July 2017. Having exercised my discretion pursuant to rule 84 Employment Tribunal Rules of Procedure 2013 to take into account the claimant’s means, the respondent’s application for costs pursuant to rule 76(1)(a) succeeds. The respondent’s costs are summarily assessed at £3,616 (no VAT).
