JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The title of these proceedings are amended to correctly record the identity of the claimant as Mr Vaithilingam Mohanarajan, not Mr Mohanarajan Vaithilingam as was incorrectly recorded in the claim form served on the respondent.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £2,084.82.[3]This sum is made up as to net monthly income at £1,697.88 and employers pension contribution (6.48 of gross income of £2,346.12), £386.64. Accordingly the total damage the claimant is entitled to recover having been dismissed in breach of contract is £2,084.52.[4]The respondent is further ordered to pay costs to the claimant under Rule 75(1)(b) in the sum of £160 in respect of the issue fee paid by the claimant in these proceedings.
