JUDGMENT
[1]As the respondent is in liquidation, the response is struck out as there is no longer a legal body to defend the claim meaning that the defence has no reasonable prospect of success.[2]The claim of unfair dismissal on the grounds of redundancy succeeds.[3]The claim for outstanding notice pay succeeds.[4]The claim for unlawful deduction of wages succeeds.[5]The claim for outstanding holiday pay succeeds.[6]The compensation awarded in respect of the above claims is as follows:- Unfair dismissal:- Basic award 12 weeks @ £439.00 = £5,269.00 Notice pay:- £150 per day x 5 days x 12 weeks = £9,000.00 (this figure is based on gross pay as no net figures are available) Outstanding wages:- 87.6 days @ £150 per day = £13,140.00 Judgment - rule 61 Page 1 of 2 Case Number: 3347138/2016 Outstanding holiday pay:- 12.4 days @ £150 per day = £1,860.00[7]In respect of the orders for outstanding wages and holiday pay, on proof of payment of the tax and NI due to HMRC the judgment debt will be met by payment of the net amount to the claimant.[8]Costs: The respondent is ordered to pay to the claimant the sum of £250 representing the costs incurred in bringing this claim.
