JUDGMENT

[1]The claimant was constructively unfairly dismissed by the respondent.[2]The claimant did not contribute to her dismissal.[3]By agreement between the parties the respondent is ordered to pay the claimant the sum of £24,354 net, on the following sums: 3.1. the sum of £15,000 to be paid by not later than 4pm 18 April 2017; 3.2. the sum of £1,00 to be paid by not later than 4pm 30 April 2017 and at the end of each subsequent month; and 3.3. the final payment of £1,354 shall be paid by not later than 4pm 29 December 2017.[4]The tribunal orders that the claimant be reinstated to the position of Senior Controller to commence on Monday 10 April 2017 at 7am. The following terms shall apply: 4.1. the claimant’s position as Senior Controller shall be full-time; 4.2. that her hourly rate of pay will be £13 gross; Case Number: 3347130/2016 4.3. that she shall work five shifts a week, commencing at 7am and ending at 7pm; 4.4. she shall sign an opt out clause in respect of working in excess of 48 hours a week; and 4.5. all rights and privileges, including seniority and pension rights, if applicable, shall be restored to the claimant by the respondent.
