JUDGMENT
[1]The Claimant was unfairly dismissed in that he was denied an appeal hearing by managers responsible for the original decision to dismiss him.[2]The Claimant would have had a 1/3rd prospect of success on appeal only.[3]The Claimant ought to have found alternative employment at a comparable rate of pay by three months after the effective date of termination, itself after 3 months’ garden leave.[4]The Respondent must pay the Claimant £3,130 (compensation of £1,930 and Tribunal Fees of £1,200) within 14 days from the date this Judgment was sent to the parties.
