[1]The claimant’s claim is dismissed on the grounds that the Employment Tribunal does not have jurisdiction to hear his claim.REASONS
[2]The claimant claims unlawful deduction of wages. The claimant’s employment is continuing.[3]The respondent is making deductions from the claimant’s wages in circumstances where the purpose of deduction is the reimbursement in respect of an overpayment of wages.[4]Consequently, by virtue of section 14 ERA 1996, the Tribunal does not have jurisdiction to hear the claimant’s claim. The complaints he makes as to the lawfulness of any deductions stand to be resolved in the County Court.
