Mr A Hawkins v Repair Calibration Ltd: 3333484/2018
JUDGMENT
Made under rule 37 of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013[1]The claims for Unfair Dismissal and for a Redundancy Payment are struck out.[2]The claims for Unpaid Wages and Notice Pay will proceed to be served on the Respondent.REASONS
Evidence
[1]On 14 November 2018 the Tribunal wrote to the Claimant to inform him that an Employment Judge was considering striking out his claims for Unfair Dismissal and for a Redundancy Payment because he did not have the necessary 2 years’ length of service and does not appear to have been made Redundant. He was given until 21 November 2018 to object to the proposal or to request a hearing at which to do so.[2]The Claimant has failed to respond to the Tribunal’s letter. The claims for Unfair Dismissal and for a Redundancy Payment are therefore struck out because they have no reasonable prospect of success.[3]The claims for Unpaid Wages and Notice Pay will proceed to be served on the Respondent. _____________________________ Employment Judge Vowles Date: …30 November 2018 Sent to the parties on: …………....................... .......................................
