Regional Employment Judge ByrneIn person for claimantMr S Liberadzki – (instructed by counsel) for respondentDate 26 April 2019

JUDGMENT

[1]The claimant’s claim for an enhanced redundancy payment correctly described as a claim for damages for breach of contract fails and is dismissed. That is because the redundancy payment made to the claimant was correctly calculated on the basis of his employment from 13 March 2016 to 6 July 2018. His argument that he should be treated as continually employed from 27 October 2003 up until 6 July 2018 failed because on the evidence heard it was found that he had resigned in November 2015 prior to taking up employment with the respondent again in March 2016. This was the only claim he presented to the Tribunal and accordingly that concludes determination of his claims.
