Ms M Maranda v Phoenix Medical Clinic Ltd: 3331286/2018
JUDGMENT
[1]The claimant’s claims of disability discrimination are dismissed on withdrawal. JUDGMENT[2]The claim of unfair dismissal, and the claims for unpaid wages and holiday pay are struck out.REASONS
[1]By a letter dated 23 August 2023 the tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why her claims (in so far as they survived, her claim of disability discrimination having been withdrawn and dismissed on its withdrawal by Employment Judge Lewis in a judgment dated 22 October 2019 which was sent to the parties on 4 November 2029) should not be struck out because they had not been actively pursued. The claimant was given until 6 September 2023 to respond to that letter.[2]The claimant has failed to make representations in writing as to why this should not be done or to request a hearing at which to make oral representations opposing the striking out of the above (i.e. her remaining) claims. Those claims (as described in the above judgment) are therefore struck out.
