JUDGMENT

[1]The Claimant’s claim for breach of contract is dismissed as it was presented out of time and the tribunal has no jurisdiction to hear it. ............................................................ JUDGMENT[2]The claimant having failed to pay the deposit ordered on 9 July 2019 as a condition of proceeding, his claims of age and race discrimination are struck out.

REASONS

[1]A preliminary hearing took place on 9 July 2019 which the claimant did not attend.[2]At the hearing the claim for breach of contract was struck out as it was out of time.[3]Having listened to representations from the respondent, the judge ordered that the claimant should pay a deposit of £100 within 28 days as a condition of being permitted to continue to advance his remaining claims of age and race discrimination.[4]No deposit payment was received within the relevant time limit. Accordingly the claims are struck out. As there are no other outstanding claims that brings the proceedings to an end.
