Mr Joseph Rollison v Berkshire Garage Ltd: 3331060/2018
JUDGMENT
[1]The respondent has made an unauthorised deduction from the claimant’s wages. The respondent is ordered to pay to the claimant £1577.70. This is the gross amount. If the respondent pays the tax and national insurance due to HMRC, payment of the net amount will meet the judgment debt.[2]This is a case of proceedings to which section 207A Trade Union and Labour Relations (Consolidation) Act 1992 applies, and it appears to the employment tribunal that the claim concerns a matter to which a relevant Code of Practice applies, and that the respondent employer has failed to comply with that Code in relation to that matter, and that failure was unreasonable. The considers it just and equitable in all the circumstances to increase the award it makes to the employee by 25%. The respondent is ordered to pay to the claimant £394.42.
