JUDGMENT

The Claimant’s claim of breach of contract is dismissed.

REASONS

[1]The Claimant was not in attendance at the Tribunal at the scheduled start of the hearing, 12.00 pm. Indeed, by the time the case came on to be heard, at 12.25 pm, the Claimant was still not in attendance. The Tribunal clerk attempted to contact the Claimant on the telephone number set out in his claim form but could not get any response.[2]In the circumstances, in light of there being no reason advanced for the Claimant’s absence, and after all practicable enquiries had been made of him, I considered that it would be appropriate to exercise my power under Rule 47 of the Employment Tribunals Rules of Procedure and to dismiss the claim due to the Claimant’s failure to attend or be represented at the hearing.
