JUDGMENT
[1]The respondent is ordered to pay the claimant unpaid wages in the sum of £1,000.00. This is a gross sum. The respondent may deduct the appropriate tax and national insurance and account to the appropriate authorities in respect of those sums. Should the respondent fail to so account, the entire sum of £1,000.00 shall be due to the claimant.[2]The respondent is ordered to pay the claimant accrued holiday pay in the sum of £262.00. This sum is a gross sum. The respondent may deduct the appropriate tax and national insurance and account to the appropriate authorities in respect of those sums. Should the respondent fail to so account, the entire sum of £262.00 shall be due to the claimant.[3]When these proceedings were begun, the respondent was in breach of its duty to the claimant under section 1(1) of the Employment Rights Act 1996 to give her a written statement of initial employment particulars. In the circumstances, the respondent is ordered to pay the claimant the sum of £1,576.61 pursuant to the provisions of section 38 of the Employment Act 2002.
