JUDGMENT
[1]By consent; The judgment of the Tribunal is that: The Respondent is ordered to pay to the Claimant the sum of £262.50 for one week’s pay in lieu of notice.REASONS
[1]The hearing was listed today to determine the Claimant’s claims for notice pay and for unpaid wages. The Respondent did not attend, as they had gone to the Watford tribunal by mistake. However, it was possible for the Judge to speak to Mr Palak Thakkar, proprietor, on the telephone, and indeed on speaker phone so that the parties could each hear what the other said.[2]The Claimant clarified that her claim was only in respect of notice pay to the value of £262.50. She was not pursuing a claim for wages for hours that she did not in fact work. She conceded that she had been paid the Case Number: 3328491/2017 hours that she had worked, and her holiday pay. It also appeared to be the case that she was provided with a letter confirming her employment although she was not able to produce this today.[3]The Respondent’s representative confirmed that he was willing to pay the notice pay, in the light of the Claimant confirming that she was not pursuing any claim for unpaid wages. The Respondent will pay that sum within seven days to the Claimant’s bank account by way of BACS transfer. The Claimant will then confirm to the Tribunal that the money has been received.[4]In the circumstances, no further action will be taken on the claim, and the sum to be paid and received is in full and final settlement of the Claimant’s claim to the Tribunal.
