JUDGMENT
[1]The complaints of unauthorised deductions from wages are well founded.[2]The respondent shall pay to the claimant the sum of £2,248.00 (which sum is gross of tax and national insurance) in respect of her complaint under section 23(1)(a) of the Employment Rights Act 1996.[3]The respondent shall pay to the claimant the sum of £139.14 (overdraft fees) which the tribunal considers appropriate in the circumstances to compensate the claimant for financial loss attributable to the unauthorised deductions from wages.[4]The tribunal cannot award interest for these claims and cannot give compensation for the stress caused by the situation.[5]No order is made for costs or preparation time relating to the conduct of the claim: the sums claimed were incurred before the presentation of the claim and do not fall within rule 76 of schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations.
