JUDGMENT
[1]The claimant does not have sufficient qualifying service to be eligible to bring a complaint of unfair dismissal.[2]Irrespective of the above, had the claimant had sufficient qualifying service, the claimant’s complaint of unfair dismissal is out of time. It was reasonably practicable for the complaint to be presented within time and it would not have been reasonable to extend time.[3]The claimant is not and was not a disabled person for the purposes of the Equality Act 2010 at the material time.[4]Again, irrespective of the above, had the claimant been a disabled person, the claimant’s complaint of disability discrimination is out of time and it would not have been just and equitable to extend time. 1 ph judgment + cm Nov 2014 wip version Case Number: 3328063/2017[5]For the avoidance of doubt, the claimant’s claims are dismissed in their entirety for lack of jurisdiction.
