The claim is struck out.REASONS
This case has been referred to me, Employment Judge Bedeau. I conducted the preliminary hearing on 13 January 2021, and took into account the claimant’s circumstances before issuing an Unless Order that he must reply to the respondent’s application to strike out his claims and to provide further information on his application to amend to add disability discrimination, by not later than 4.00pm 22 February 2021. I made clear to him and his wife, the consequences should he fail to comply, in that, his claims would be struck out. They both understood. On 17 February 2021, he wrote applying for a two weeks’ extension of time in order to comply with the Orders as a lawyer is considering his file and unlikely to respond by the deadline. If he has instructed a lawyer, he or she has not written to the tribunal stating that they now represent him. I am not persuaded that a lawyer currently represents him. The respondent’s representatives submitted on 25 February 2021, that this is merely a continuation of what is a pattern, namely that extensions of time are frequently requested on the basis that he is seeking legal advice. The case has been ongoing for over a year and nothing has been achieved since the last hearing. It unlikely that there will be any progress in the future.
