Ms C Joseph v East London NHS Foundation Trust: 3325825/2019
JUDGMENT
[1]Following the Claimant’s application to reinstate her claims of sex discrimination, race discrimination, victimisation and whistleblowing detriment, this application is treated as an application for reconsideration, lodged out of time.[2]The claims were withdrawn by the Claimant and dismissed by the Employment Tribunal on 16 February 2021 (see paragraph 4 of the Case Management Summary). In accordance with Rules 51 and 52 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, these claims have come to an end and the Tribunal has no jurisdiction to set aside the withdrawal and/or dismissal of the claims.[3]Further, any request for reconsideration, in so far as any such request is permissible, is dismissed under Rule 72 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 as having no reasonable prospect of success and being out of time. 23rd July 2021
