JUDGMENT
The claimant’s claim of breach of contract or unlawful deductions from wages (in respect of amounts deducted for private mileage only) is dismissed on withdrawal.REASONS
[1]The claimant was ordered to pay a deposit of £200 following a preliminary hearing held on 11 June 2020. The Order was sent to the claimant on 22 July 2020. The claimant has failed to pay this deposit. The complaint of race discrimination is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 11 March 2021 will now take place before an employment judge alone starting at 10 am or as soon as possible afterwards with a time estimate of 3 hours to consider the claimant’s claim in respect of the £702.34 deduction for repairs to his car. _____________________________ Employment Judge Anstis Date: 13 October 2020[1]The proceedings were held back until 10:17 to ensure the claimant had not emailed the Tribunal with any problems joining the Cloud Video Platform and none were found.[2]The claimant’s claim of unlawful deduction of wages is therefore dismissed as the claimant’s failure to attend today’s hearing confirms the claimant is no longer actively pursuing the claim of unlawful deduction of wages.
