JUDGMENT
[1]The 1st Respondent gave an undertaking to the Tribunal and to the Claimant that it would accept liability for the conduct of the 2nd, 3rd, 4th and 5th Respondents (employees of the 1st Respondent), and accept responsibility for any remedy awarded by the Tribunal in respect of their conduct, and would call them to give evidence at the re-listed full merits hearing and would not seek to rely upon the defence in section 109(4) Equality Act 2010.[2]In reliance upon that undertaking the Claimant withdrew the claims against the 2nd, 3rd, 4th and 5th Respondents individually and they are removed from the proceedings.[3]All claims will continue to be pursued against the 1st Respondent.
