JUDGMENT
[1]The claimant was fairly dismissed by the respondent is his complaint of unfair dismissal fails.[2]The claimant’s claim for breach of contract (notice pay) fails and is dismissed.[3]The claimant’s claim for holiday pay fails and is dismissed.[4]The claimant’s claim for arrears of pay is upheld in part and the respondent is ordered to pay to him the net sum of £109.95.[5]The deposit sum of £250 paid by the claimant is awarded to be paid out to the respondent in accordance with Rule 39.5(b) of the Tribunal Rules of Procedure.[6]The respondent’s costs application is adjourned and will be dismissed unless within 28 days of the day on which this judgment is sent out the respondent sends a full application in writing to the Tribunal and the claimant.
