JUDGMENT
[1]All and any complaint of unfair dismissal is struck out because, taking into account the Claimant’s length of service, and the alleged dismissal reason, the proposed unfair dismissal complaint is not within the jurisdiction of the Tribunal.[2]In the alternative, the complaint (if any) of unfair dismissal based on section 100 of the Employment Rights Act 1996 is struck out because it has no reasonable prospects of success.[3]The other complaints are not struck out. Those other complaints are as described in the case management summary which has been sent to the parties. Reasons for refusing the Respondent’s application were given orally, and written reasons are included in the case management summary.
