JUDGMENT

[1]The claims for unfair dismissal, automatic unfair dismissal, notice pay and failure to provide written reasons for dismissal have no reasonable prospects of success as the claimant was not dismissed. Those claims are struck out.[2]If I had not struck those claims out, I would have ordered deposits be paid as a condition of them proceeding as they have little reasonable prospects of success. I would have ordered deposits of £500 for the unfair dismissal claims; £250 for the notice pay claim and £250 for the failure to provide written reasons for dismissal claim.[3]The claimant has withdrawn the issue at 6.1.3 of the list of issues of today’s hearing (issue 9.1.3 of the February 2023 hearing) and that allegation is dismissed on withdrawal.[4]The claimant has withdrawn any allegation that he suffered personal injury as a result of negligence by the respondent and that matter is dismissed on withdrawal.[5]The remaining claims of disability discrimination, victimisation and public interest disclosure detriment proceed to a hearing as set out in the case management summary of today’s date. 1 of 2 Case Number: 3323440/2021
