The claim is struck out.REASONS
[1]By a letter dated 6 September 2023 the Tribunal gave the claimant (by writing to the Claimant directly) an opportunity to contact the Tribunal by 20 September 2023 to make representations or to request a hearing, as to why the claim should not be struck out because the claimant’s representative had not replied to the strike out warning dated 18 July 2023 (which had required response by 1 August 2023) which proposed strike out because The Claimant had not complied with the Orders of the Tribunal dated 5 August 2022 and 12 March 2023 it has not been actively pursued.[2]As of 1 November 2023, the claimant and his representative have each failed to make representations in writing and failed to ask for a hearing. The claim is therefore struck out.[3]The scheduled hearing fixed for 15 to 22 April 2024 will not take place.
