JUDGMENT
[1]The claims of unfair dismissal are dismissed having been brought out-of-time.[2]The remaining claims will be dismissed after 14 days from today unless within that period the Claimant applies for another Preliminary Hearing to establish jurisdiction in respect of those claims. Such a Preliminary Hearing to be heard before Employment Judge Smail with a time estimate of 2 hours. Reasons for Order 2 above. The evidence, cross-examination and submissions as developed before me today focused on the tests under section 111(2) of the Employment Rights Act 1996 in respect of unfair dismissal. The issues in respect of unauthorised deductions from earnings and unpaid holiday pay focus on slightly different timings. They were not dealt with today. Findings made today may well impact on those issues.
