JUDGMENT
The claim for unlawful deduction of wages is dismissed.REASONS
[1]The Claimant was employed by the Respondent as an electrician between 16-18 August 2021 at a salary of £26,000.[2]On 28 October 2021 he brought a claim alleging he had not been paid for those 3 days of work.[3]On 22 November 2021 the Respondent stated the Claimant had failed to return his uniform but that it had now nonetheless paid him the £240 the Claimant was owed and included a payslip to that effect. Case Number: 3322766/2021 (CVP)[4]On 23 February 2022 the Tribunal sent a notice of hearing to both parties stating the matter would be heard today (20 April 2022) via a video-link. The Tribunal sent a further letter to the Claimant asking him if he agreed with the Respondent that he had been paid what he was owed and if he wished to continue with his claim. Although the Claimant was asked to reply within 7 days, there is no response to that letter on file.[5]The Claimant did not attend the hearing today, nor make contact with the Tribunal to explain his non-attendance.[6]In view of the payslip indicating the Claimant has been paid, the Claimant’s failure to respond to the Tribunal’s letter of 13 February 2022, and his non-attendance today, I am satisfied the Claimant has been paid the wages he was owed and/or that he is no longer pursuing a claim for unpaid wages.[7]The claim for unlawful deduction of wages is therefore dismissed.
