Mrs A Wilkins v M Burch: 3322308/2019
JUDGMENT
The response is struck out.REASONS
[1]By a letter dated 7th January 2022 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because the respondent had not complied with the Order of the Tribunal dated 7th January 2022.[2]The respondent has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The response is therefore struck out.[3]The respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Employment Judge. 23/2/2022 _____________________________ Employment Judge Ord[1]The claimant is awarded the sum of £7,000 for the acts of sex discrimination and harassment as set out in her claim form and her witness statement. Preparation Time Order[2]The respondent has continually failed to attend hearings in this case or to participate in the hearing. He has thereby caused delay and I consider his conduct to be unreasonable in the way that he has conducted these proceedings in accordance with Rule 76(1)(a) Employment Tribunal Rules of Procedure.[3]The claimant has attended three hearings, at none of which has the respondent attended. Has had to prepare for her hearings including todays.[4]I consider an appropriate preparation time order for 12 hours preparation time at the appropriate rate of £41 per hour. Accordingly, a preparation time order is made in the sum of £492. 5 August 2022
