JUDGMENT
[1]The Claimant is not disabled for the purposes of s. 6 of the Equality Act 2010 and his claim of disability discrimination is dismissed.[2]The claim of direct race discrimination has no reasonable prospect of success and is struck out under rule 37 of the Tribunals Rules of Procedure.[3]The unspecified claim under the Working Time Regulations is dismissed on withdrawal by the Claimant.[4]The claims of unfair dismissal and breach of contract (notice pay) will proceed to a hearing. This has been a remote hearing which has been consented to by the parties. The form of remote hearing was CVP (kinly). A face to face hearing was not held because it was not practicable and all issues could be determined in a remote hearing.
