JUDGMENT

The against Second Respondent (namely Mr Bagels Ltd) is struck out.

REASONS

[1]By a letter dated 22 June 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim against 2nd Respondent should not be struck out because it  it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim against 2nd Respondent is therefore struck out.[3]The claimant’s remaining claim(s) remains listed for hearing on 18th August 2022. _____________________________ Employment Judge Hymans 10 August 2022[1]The claimant’s claim of unfair dismissal is struck out as it was not presented within the time limit set out in section 111(2) of the Employment Rights Act 1996 when it was reasonably practicable for him to have done so.[2]The claimant’s claim of automatic unfair dismissal pursuant to section 102A of the Employment Rights Act 1996 is struck out as it was not presented within the time limit set out in section 111(2) of the Employment Rights Act 1996 when it was reasonably practicable for him to have done so.[3]The claimant’s claim of detriment of the Employment Rights Act 1996 is struck out as it was not presented within the time limit set out in section 48(3) of the Employment Rights Act 1996 when it was reasonably practicable for him to have done so.[4]The respondent’s application for a costs order is refused.
