JUDGMENT
[1]The claimant was an employee of the respondent.[2]The claim for unlawful deduction from wages succeeds. The respondent has made an unlawful deduction from the Claimant’s wages and is ordered to pay the sum of £1,054.05 being the total gross sum, in respect of the amount unlawfully deducted. The Respondent made unlawful deductions from wages by not paying wages due in August 2022.[3]The claim for holiday pay succeeds. The respondent made an unauthorised deduction from wages by failing to pay the claimant in lieu of accrued but untaken holiday and is ordered to pay to the claimant the sum of £300.81.[4]The Tribunal makes a declaration that the Claimant was not given itemised pay statements (payslips) in accordance with s.8 Employment Rights Act 1996, despite their employment. No compensation is ordered regarding this failure.
