JUDGMENT
[1]The Respondent, in breach of contract, has failed to pay the Claimant in respect of excess benefits in kind and is ordered to compensate him in the sum of £5,319.72.[2]The Respondent, in breach of contract, has failed to pay pension contributions for the Claimant and is ordered to compensate him in the sum of £1,333.44.[3]The Respondent has made unauthorised deductions from the Claimant’s wages in respect of commission earnings and is orered to pay him the sum of £33,031.00.REASONS
[1]On 30 July 2019 the Claimant presented claim to the tribunal alleging unauthorised deductions and breach of contract. On 30 September 2019 the Respondent presented a response in which it simply put the Claimant to proof of what he was owed. Case Number: 3321044/2019 (V)[2]On 22 September 2020 the Respondent went into Administration. Its statement of affairs shows a deficiency in excess of £127,000,000. On 22 October 2020 the Administrators gave consent for this claim to proceed.[3]The Respondent has not appeared or been represented in this hearing. I took the view it was in the interests of justice for the case to proceed in the Respondent’s absence.[4]I heard the evidence of the Claimant. He confirmed the accuracy of his schedule of loss. I have no reason to doubt that evidence. I make the above awards.
