[1]The respondent’s application to amend its response to address the specific and discreet issue as to whether or not the claimant had been dismissed is granted.[2]The issue of remedy is to be dealt with at a separate hearing.[3]The claimant was unfairly dismissed by the respondent.[4]There was a breach of the claimant’s terms and conditions of employment by the respondent.[5]The claimant’s claim for notice pay succeeds.[6]The claimant’s claim of unlawful deductions from his wages pay succeeds.[7]The tribunal will decide the remedy at a further hearing on 23 February 2022. This will include the consideration as to whether or not the claimant should be reinstated to his previous position.
