JUDGMENT
Following the Strike Out Warning dated 10 November 2022 the Claimants Claims are dismissed as no longer actively pursued and the continued failure to comply with the Case Management Orders.REASONS
By a letter dated 10 November 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because[1]You have not complied with the Order of the Tribunal dated 8 April 2022.[2]It has not been actively pursued. It is disingenuous to suggest having issued a Claim on 29 September 2021 and correspondence being sent to the Claimant as per his instructions in the ET1 from the Employment Tribunal and the Respondent to suggest nothing has been received by the claimant, and further done nothing in the meantime over the 12 months to ascertain the position. The hearing fixed for 29 November 2022 will not take place.
