JUDGMENT
[1]The decisions on the preliminary issues are that, at the relevant times: 1.1. There was no contract of employment between the parties 1.2. There was no contract between the parties such that the Claimant was a “worker” within the definition in section 230(3)(b) of the Employment Rights Act 1996[2]As a result of the decisions on the preliminary issues the entire claim is dismissed.[3]It is not necessary or appropriate to make a decision on the Respondent’s application that there were grounds to strike out the claim because, according to the Respondent, there has been an abuse of process and/or the manner in which the proceedings have been conducted has been unreasonable and/or there has been a failure to comply with case management orders.
