JUDGMENT
[1]It was reasonably practicable for the claimant to have presented his claim for unfair dismissal within the period of three months specified in section 111(2) (b) of the Employment Rights Act 1996. The Tribunal therefore has no jurisdiction to consider the claimant’s claim because the Claim Form was not presented within the time limit required by section 111(2).[2]Alternatively, if the Tribunal does have jurisdiction to hear the claim, the Tribunal exercises its power under Rule 37(1)(a) of The Employment Tribunals Rules of Procedure 2013 to strike out the claim on the grounds that it has no reasonable prospects of success.
