JUDGMENT
[1]By consent the respondent has agreed to pay the claimant £374 subject to statutory deductions in respect of the claim for sums due for the period 1 to 8 March 2019.[2]The respondent has unlawfully deducted pay contrary to s13 of the Employment Rights Act 1996 equivalent to 17 hours in respect of January 2019. This is an unlawful deduction of wages in the amount of 17 hours x £8 (hourly rate) = £136 less statutory deductions.[3]The respondent has breached regulation 16 of the Working Time Regulations 1998 by failing to pay the claimant holiday pay in the amount of 12.6 days at a day rate of £68 (8 hours per day at £8 per day) = £858.8 less statutory deductions.[4]This is a total amount of: £1,366.80 less statutory deductions.
