JUDGMENT
UPON consideration of the file and further upon consideration of the respondent’s position as explained by Mr Thomas Clarke at a telephone preliminary hearing on the 1 April 2020 when the claimant did not attend. And further UPON been satisfied that the respondent has been given a reasonable opportunity to make any representations either in writing or at a hearing and no such request being made[1]The respondent’s response to the claim for holiday pay is struck out pursuant to rule 37(1)(a) on the grounds that the response has no reasonable prospect of success.[2]The respondent failed to pay to the claimant holiday pay and the respondent is ordered to pay to the claimant the sum of £331.00.
