JUDGMENT

[1]The claimant’s claim for unlawful deduction from wages in respect of arrears of pay succeeds.[2]The respondent is ordered to pay the claimant the sum of £2,953.98 in arrears of pay as follows:a. £904 for October 2020;b. £720 for November 2020;c. £644 for December 2020;d. £827.18 for January 2021;e. £747.18 for February 2021; andf. £827.18 for March 2021.[3]From the sums owing to the claimant, £1,716.16 received in universal credit has been deducted by the claimant.[4]The respondent failed to provide the claimant with written particulars of employment, in breach of section 1 of the Employment Rights Act 1996. The respondent is ordered to pay the claimant the additional sum of £1,076 in respect of the failure to provide written particulars.[5]The total sum which the respondent is ordered to pay to the claimant is £4,029.98.
