JUDGMENT
[1]There was a ‘relevant transfer’ (within the meaning of Regulation 3(1) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”)) of the Second Respondent’s business to Sharon Butcher in September 2020, with the effect that, pursuant to Regulation 4(1) of TUPE, all the Second Respondent’s rights, power, duties and liabilities under or in connection with his contract of employment with the Claimant transferred to her. Case Number: 3313894/2020[2]In the circumstances the Claimant’s claims against the Second and Third Respondents are struck out on the grounds that they have no reasonable prospects of success.
