JUDGMENT
The claimant’s claim of age discrimination is struck out.REASONS
[1]By a letter dated 21 August 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim of age discrimination should not be struck out because the claimant had not complied with the Order of the Tribunal dated 10 March 2021 and it has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim of age discrimination is therefore struck out.[3]The hearing fixed for 27 & 28 June 2022 will now be vacated, and the preliminary hearing on 28 January 2022 converted to a final hearing, to take place by video (CVP) before an employment judge sitting alone, to consider the claimant’s remaining claims for holiday pay and arrears of pay. The orders set out in the notice of hearing dated 22 May 2021 will continue to apply to those remaining claims.
