JUDGMENT
[1]The respondent was entitled to deduct £36.00 from the claimant’s final pay, in part in respect of an overpayment and in part authorised by a relevant provision of the claimant’s contract. This means the claimant’s claim for unauthorised deduction in respect of arrears of pay does not succeed.[2]The respondent was not entitled to deduct pay for accrued but untaken holiday pay from the claimant’s final pay. This means that the claimant’s claim for holiday pay succeeds.[3]The claimant was entitled to 4.8 hours accrued but untaken holiday at the time of the termination of her employment. The respondent is ordered to pay the claimant £43.20 in respect of holiday pay. This is the gross figure.
