JUDGMENT

[1]The Tribunal declares that the Respondent breached the Claimant’s contract of employment when it failed to pay the employer and employee pension contributions into her Nest Pension Scheme in accordance with the terms of the contract. The Tribunal orders the Respondent to pay to the Claimant the sum of £7631.36 as damages for breach of contract.[2]The Tribunal declares that the Claimant’s complaints that the Respondent made unauthorised deductions from her wages contrary to s.13 of the Employment Rights Act 1996 is well-founded and succeeds and orders the Respondent to pay the sum of £24,252.23 to the Claimant. This is a net sum and any income tax and national insurance due will be paid by the Respondent separately and without deduction from the sum awarded.[3]The name of the Respondent was amended from Martin Reddington to Martin Reddington Associates Limited by agreement with both parties.
